Privacy Policy
How we handle personal information when you visit our website, contact us or place an order.
Effective date:
1. Who we are and the scope of this policy
Occasion & Memory is owned and operated by The Nice Stuff Co Ltd (Hong Kong). In this policy, "we", "us" and "our" refer to this company, which provides the custom gifting services described on this website. We are responsible for the personal information described in this policy, except where we process information solely on a business customer's instructions under a separate agreement.
This policy covers our website, inquiries, quotations, project communications and orders. Personal information means information that identifies an individual or can reasonably be linked to one, including a named business contact.
2. Information we collect and keep
- Contact and customer information. Your name, email address, company or organisation, country or state, and other contact details you provide. If an order requires them, this may include a telephone number, billing address, delivery address and recipient contact details.
- Inquiry and project information. The occasion, intended audience, project objectives, product preferences, artwork or personalisation details you provide, quantities, budget, requested timing, quotations, approvals and correspondence.
- Order and transaction records. If you place an order, we keep the agreed specifications, order reference, prices, invoices, payment status and related accounting records, production and shipment details, and records of returns, complaints or after-sales support. The inquiry form does not collect payment card details.
- Website and delivery records. Our hosting and email providers process technical information needed to provide and secure their services, which may include IP addresses, request times, browser information and delivery logs. We also keep inquiry submission times, the source page and email delivery status.
We obtain information directly from you, from the organisation or person arranging a gift or order for you, and from providers involved in payment or delivery where relevant to the order. Please provide other people's information only where you are entitled to do so and make this policy available to them. Avoid including identity documents, sensitive personal information or recipient lists that are not needed for your request.
Fields marked as required are needed to assess and respond to an inquiry. If you do not provide them, we may be unable to respond or arrange the requested service. Other information is optional unless needed for an agreed order or a legal requirement.
3. How we use information
- Respond to inquiries, clarify requirements, develop recommendations and prepare quotations.
- Manage artwork, samples, approvals, production, payments, shipping, customs clearance and after-sales support for agreed orders.
- Communicate about your request or order, including follow-up questions, quotation updates, approvals, delivery arrangements and service issues.
- Maintain business and accounting records, comply with legal obligations, resolve disputes and prevent fraud or misuse.
- Maintain and protect the website and investigate service or email delivery problems.
4. Applicable privacy requirements
We use personal information for the purposes described in this policy, subject to applicable privacy requirements. Where consent is required for a particular use or disclosure, we obtain it separately. This policy does not waive your statutory rights or replace a legally required consent.
5. Service communications and marketing choices
We may contact you using the details you provide to discuss your inquiry and any resulting order. Submitting an inquiry does not subscribe you to a newsletter or, by itself, constitute consent to unrelated promotional messages.
If you separately choose to receive promotional emails about our own products or services, we may use your contact details for that purpose. You can unsubscribe using the instructions in the message or contact us to withdraw your choice. Declining marketing does not prevent you from requesting a quote or placing an order. Essential communications about an active order or a legal obligation may still be necessary.
6. When information is disclosed
We do not sell or rent your personal information, share it for cross-context behavioural advertising, or disclose it to third parties for their own independent marketing.
We disclose information only as needed for the purposes described in this policy, including to:
- Technology and communication providers. Cloudflare hosts the website and stores submitted inquiries in its D1 database. Resend processes inquiry notification emails. These services process submitted contact and project details and the technical or delivery information needed for their services. Providers supporting our business communications may also process the information in those communications.
- Order fulfilment providers. Where needed for an agreed order, production partners may receive specifications and personalisation details, while carriers, customs agents and payment or accounting providers may receive the information needed for their part of the order. A production partner does not need an entire customer contact record merely to manufacture a product.
- Professional advisers and public authorities. Information may be disclosed where necessary for professional advice, compliance with a legal obligation or lawful request, or the establishment, exercise or defence of legal claims.
Disclosures are limited to information relevant to the recipient's role. Where a recipient acts as our processor, appropriate written terms must govern its processing on our behalf. Some recipients, such as carriers, payment providers or public authorities, may act as independent controllers for their own legal responsibilities.
7. International processing and transfers
Personal information you provide in connection with an inquiry or order will be accessed and processed in mainland China as part of handling your request and arranging our services. This may include your contact details, project requirements, correspondence and, where relevant, order or delivery information. If you are in the United States, this means your information will be processed outside the United States.
Information is also processed by the technology and communication providers we use. Resend states that it stores service data in the United States. Data protection laws and public authority access rules in these countries may differ from those where you live. We disclose information according to the purposes and recipient roles described in this policy.
8. How long we keep information
We retain information for the time needed for the purpose for which it was collected. For inquiries that do not become orders, this depends on the status of the request, the last substantive communication and whether follow-up remains reasonably expected. For orders, this includes fulfilment, after-sales obligations, applicable accounting and tax requirements, and the time reasonably required to handle disputes or legal claims.
Marketing preferences are retained while relevant to your choice; a limited suppression record may be kept to honour an opt-out. Security and delivery logs are retained according to their operational purpose and the provider's applicable settings. Information subject to a legal retention requirement or a legal hold may need to be kept longer. When retention is no longer justified, we delete or irreversibly anonymise the information, including through the applicable backup lifecycle.
9. Security
We take reasonable technical and organisational measures designed to protect personal information, including limiting access to information needed for the relevant task. No method of online transmission or storage can guarantee absolute security. Please do not send payment card details or unnecessary sensitive information through the inquiry form.
10. Cookies, analytics and automated decisions
The current website application does not include advertising pixels or optional analytics scripts. Hosting and security services may still process technical request information needed to operate the site. Any introduction of optional tracking requires an updated notice and, where required, a choice before it is used.
We do not use third-party tracking technologies on this website to collect information about your activities over time and across unrelated websites for advertising purposes. The website does not change its behaviour in response to browser Do Not Track signals. We do not sell personal information or share it for cross-context behavioural advertising, regardless of whether your browser sends a Global Privacy Control signal.
We do not use inquiry information to make decisions based solely on automated processing that produce legal or similarly significant effects on you.
11. Your privacy rights
Depending on the law that applies, you may have rights to confirm whether we process your personal information, access or obtain a copy of it, correct it, request deletion, restrict processing, receive certain information in a portable format, or object to processing. Applicable U.S. state laws may also provide rights to information about specific third-party recipients and to opt out of the sale or sharing of personal information, targeted advertising or certain profiling activities.
Where processing relies on consent, you may withdraw it without affecting the lawfulness of earlier processing. You can ask us to stop direct marketing at any time. We will not unlawfully discriminate against you for exercising an applicable privacy right.
To make a request or raise a concern, contact privacy@occasionmemory.com. Please describe your request and provide enough information for us to locate the relevant record. Where permitted by law, an authorised agent may submit a request on your behalf. We may ask for proportionate information to verify your identity or the agent's authority and will respond within the period required by applicable law. Some requests are subject to legal exceptions, which we will explain where relevant.
If we decline your request, you may ask us to review that decision by replying to our response or emailing privacy@occasionmemory.com with the subject "Privacy Appeal". We will explain the outcome within the period required by applicable law. If an appeal is denied, we will also explain how to contact the relevant state attorney general or other regulator where required. You may complain to the regulator with jurisdiction over your concern.
12. Children and information about recipients
Our website and inquiry services are intended for adults and business contacts. We do not knowingly collect personal information from children under 13. Please do not submit children's personal information through the inquiry form. If you believe we have received information about a child improperly, contact privacy@occasionmemory.com so we can review and address it.
13. Changes to this policy
We will update this policy when our practices or legal requirements change and revise the effective date shown above. For material changes, we will post a prominent notice on the website or notify affected people using the contact details available to us, as appropriate and required by law. Where required, we will obtain consent before using personal information for a new purpose.
